John Shutt focuses on assisting mortgage lenders, banks, servicers, brokers and other financial institutions as a Regulatory Compliance Analyst.
John has extensive experience in providing compliance guidance in all 50 states regarding mortgage loan origination issues such as licensing, loan documentation and disclosures, allowable interest rates, late fees and prepayment fees, escrow accounts and predatory high-cost home loan restrictions.
John served for several years as in-house litigation counsel for a large mortgage loan servicing company, where he successfully resolved a large number of borrower disputes and litigation matters quickly and efficiently. He has extensive experience in defending servicers and investors, in conjunction with local counsel in all 50 states, from borrower disputes and lawsuits ranging from RESPA "qualified written request" disputes, TILA rescission demands, FCRA credit reporting disputes, regulatory investigations and other governmental proceedings, contested foreclosure and eviction actions, bankruptcies, civil claims, as well as large interstate putative class actions.
John has defended numerous actions asserting violations of a wide range of federal and state consumer protection statutes such as the Truth In Lending Act, the Real Estate Settlement Procedures Act, the Home Ownership & Equity Protection Act, the Equal Credit Opportunity Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act and the National Flood Insurance Act.
John also served as Chief Compliance Officer for a national electronic document preparation company, where he provided services to thousands of residential mortgage clients such as residential mortgage brokers and lenders, state and federally chartered banks, credit unions, saving banks, savings and loan associations and industrial loan companies.
He is also the founder and co-owner of the Residential Mortgage Compliance Center ("RMCC"). RMCC is one of the leading providers of federal and state mortgage compliance information and consulting services for the mortgage industry.
John is the author of the "Legal Internet Guide: Lawdesk Reference," which was sold to LexisNexis (Spring 2001), and the co-author of the article, "Defending Servicers Against Consumer Credit Reporting Claims," published in the Mortgage Servicing News (Winter 2004).
John is admitted to practice law in Massachusetts. He received his undergraduate degree from Brigham Young University (BYU), and his Juris Doctor from the Massachusetts School of Law. He is a member of the Mortgage Bankers Association, the Conference on Consumer Finance Law, as well as the Massachusetts Bar Association.
